From RFQ to Subcontractor Contract: Automating the Tender Cycle in Construction

Italian Regulatory Framework
The new Public Contracts Code (D.Lgs. 36/2023, effective July 2023) redefined subcontracting obligations. Key points: subcontracting is now allowed up to 100% of contract value (vs previous 40% cap), SOA qualification verification remains mandatory, payment traceability via dedicated accounts with CIG/CUP is required by Law 136/2010, and the main contractor bears joint liability for subcontractor employee payments.
Automating the RFQ Cycle
Modern systems replace the Excel spreadsheet with a structured subcontractor database including SOA qualification status with expiry alerts, DURC validity, insurance certificates, and performance history. Multi-supplier RFQ dispatch becomes a single click, with subcontractors completing structured online forms rather than sending PDF attachments.

Contract Generation and Digital Signature
Once a subcontractor is selected, the system auto-generates a legally updated contract template populated with registry data. Digital signature via DocuSign, Namirial, or InfoCert Sign (all eIDAS-compliant) replaces the print-sign-scan-mail cycle. Qualified electronic signatures (FEQ) have the same legal value as handwritten signatures under Italian law.
